The new Federal Rules of Civil Procedure (FRCP) have codified the need for comprehensive document destruction plans under FRCP 37(c) by providing a safe harbor for documents destroyed in the routine course of business in accordance with a document destruction plan. But, while most practitioners understand the need, implementing such plans on a business-by-business basis requires careful preparation and detailed follow-through.
